    • Disrupt or interfere with the Platform’s functionality.

    • Post false, misleading, or fraudulent job listings or content.

    • Use automated scripts, bots, or scraping tools to extract data from the Platform.

7. Data Protection and Privacy

  • Data Collection: We collect and process personal data in accordance with our Privacy Policy. This includes candidate information, user account details, and usage data.

  • Data Usage: Data is used to provide, improve, and personalize our services, and to comply with legal obligations.

  • Data Security: We implement industry-standard security measures to protect your data. However, no method of transmission over the internet is 100% secure.

  • User Rights: You retain ownership of your data but grant Talma.ai a limited license to use it for the purpose of delivering our services.

  • Candidate Data: If you upload candidate data, you represent and warrant that you have obtained all necessary consents and permissions to share such data with Talma.ai.

8. Intellectual Property

  • All content, trademarks, logos, software, and other intellectual property on Talma.ai are owned by us or our licensors.

  • You may not reproduce, distribute, modify, or create derivative works of our content without explicit written permission.

  • You grant Talma.ai a non-exclusive, worldwide, royalty-free license to use any content you upload or submit to the Platform, solely for the purpose of providing our services.

9. Confidentiality

  • You agree to treat all information related to the Platform, its technology, business processes, and user data as confidential.

  • This obligation survives the termination of your use of the Platform.

  • Confidential information does not include data that becomes publicly available through no fault of yours or was lawfully known to you prior to disclosure.

10. Indemnification

You agree to indemnify, defend, and hold harmless Talma.ai, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected to:

  • No Guarantees: Talma.ai does not guarantee job placements, candidate quality, or the success of any recruitment process.

  • Limitation of Liability: To the fullest extent permitted by law, Talma.ai shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

  • Third-Party Services: The Platform may integrate third-party services (e.g., payment processors, communication tools). We are not responsible for the actions or policies of these third parties.

13. Governing Law and Dispute Resolution

  • These Terms are governed by the laws of France.

  • Any disputes arising from these Terms or your use of the Platform will be resolved exclusively in the courts of Paris, France.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
